Use and Consent
The following Terms and Conditions apply when you view or use the Site, located at http://www.thinktuitive.com (the “Site”), or purchase any course, ebooks, templates, or other information products or services, including workshops and coaching session via our website (hereinafter cumulatively referred to as the “Program”, or “Service”). You agree to abide by these Terms and Conditions (“Terms”), as they may be amended by ThinkTuitive, LLC, a limited liability company organized and operating under the laws of the state of California (“Company”) from time to time. Company will post a notice on the Site any time these Terms have been changed or otherwise updated. Please review the following terms carefully. By accessing or using the Site, you signify your agreement to these Terms. If you do not agree to these Terms, you may not access or use the Service.
To use our Programs, Products, Services or Program Materials, we may seek personal data or information including your name, e-mail address, phone number, street address, billing information, birthday, preferences, interests, assignments, or other personally-identifying information (“Confidential Information”), or you may offer or provide a comment, photo, image, video or any other submission to us when using or participating in our Programs, Products, Services or Program Materials (“Other Information”).
What We Do With Confidential Information.
We request and require various personal data and/or Confidential Information to understand your needs and provide you with better services. In addition, we may use such data and Confidential Information for the following reasons: (1) for internal record keeping, (2) to improve our Programs, Products, Services or Program Materials, (3) to periodically send promotions about new Programs, Products or Services or other special offers from which you may unsubscribe at any time, (4) for aggregate, non-identifiable data for research purposes, (5) to customize the respective Programs, Products or Services you purchase or use according to your interests and/or (6) for support or communication related to your Program, Product, Service or Program Materials.

Viewing by Others. Note that whenever you make your Confidential Information or Other Information available for viewing by others, we cannot be responsible for any unauthorized use by others of such Confidential Information or Other Information that you voluntarily share online or in any other manner. This is true whether you make such information available through our Programs, Products, Services, or Program Materials, our Website or social media.
Registration; Rules for User Conduct and Use of the Site
The Site is intended only for users aged 18 or older. Individuals under the age of 18 are strictly prohibited from using the site and the accounts for any such person shall be terminated upon discovery.
Users are required to create a personalized account which includes a unique username and a password to access the Site and to receive messages from the Company. You agree to notify us immediately of any unauthorized use of your password and/or account. The Company will not be responsible for any liabilities, losses, or damages arising out of the unauthorized use of your member name, password and/or account.
Posting and Conduct Restrictions
When you create your own personalized account, you may be able to provide (“User Content”). You may also be invited to post User Content to any ThinkTuitive social media forum. You are solely responsible for the User Content that you post, upload, link to or otherwise make available whether to the Site or to one of our social media accounts. You agree that we are only acting as a passive conduit for your online distribution and publication of your User Content. The Company, however, reserves the right to remove any User Content from the Site at its discretion.
The following rules pertain to User Content. By transmitting and submitting any User Content while using the Site or social media forums, you agree as follows:
- You are solely responsible for your account and the activity that occurs while signed in to or while using your account;
- You will not post information that is malicious, false or inaccurate;
- You will not submit content that is copyrighted or subject to third party proprietary rights, including privacy, publicity, trade secret, etc., unless you are the owner of such rights or have the appropriate permission from their rightful owner to specifically submit such content; and
- You hereby affirm we have the right to determine whether any of your User Content submissions are appropriate and comply with these Terms, remove any and/or all of your submissions, and terminate your account with or without prior notice.
You understand and agree that any liability, loss or damage that occurs as a result of the use of any User Content that you make available or access through your use of the Site is solely your responsibility. The Company is not responsible for any public display or misuse of your User Content. The Company does not, and cannot, pre-screen or monitor all User Content. However, at our discretion, we, or technology we employ, may monitor and/or record your interactions with the Site.
Your permission to use the Site is conditioned upon the following Use Restrictions and Conduct Restrictions: You agree that you will not under any circumstances:
- post any information that is abusive, threatening, obscene, defamatory, libelous, or racially, sexually, religiously, or otherwise objectionable and offensive;
- use the Site for any unlawful purpose or for the promotion of illegal activities;
- attempt to, or harass, abuse or harm another person or group;
- use another user’s account without permission;
- provide false or inaccurate information when registering an account;

- make any automated use of the system, or take any action that we deem to impose or to potentially impose an unreasonable or disproportionately large load on our servers or network infrastructure;
- bypass any robot exclusion headers or other measures we take to restrict access to the Site or use any software, technology, or device to scrape, spider, or crawl the Site or harvest or manipulate data; or
- publish or link to malicious content intended to damage or disrupt another user’s browser or computer.
Permission is granted to download one copy of the materials (information) on Company’s web site. This is the grant of a non-transferable license, not a transfer of title, and under this license you may not:
- remove any copyright or other proprietary notations from the materials; or
- transfer the materials to another person or ‘mirror’ the materials on any other server.
This license shall automatically terminate if you violate any of these restrictions at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
Online Content Disclaimer
Opinions, advice, statements, offers, or other information or content made available through the Site, but not directly by the Company, are those of their respective authors, and should not necessarily be relied upon. Such authors are solely responsible for such content. The Company does not guarantee the accuracy, completeness, or usefulness of any information on the Site and neither does the Company adopt nor endorse, nor is the Company responsible for, the accuracy or reliability of any opinion, advice, or statement made by parties other than the Company. The Company takes no responsibility and assumes no liability for any User Content that you or any other user or third-party posts or sends over the Site. Under no circumstances will the Company be responsible for any loss or damage resulting from anyone’s reliance on information or other content posted on the Site or transmitted to users.
Though the Company strives to enforce these Terms, you may be exposed to User Content that is inaccurate or objectionable. The Company reserves the right, but has no obligation, to monitor the materials posted in the public areas of the Site or to limit or deny a user’s access to the Site or take other appropriate action if a user violates these Terms or engages in any activity that violates the rights of any person or entity or which we deem unlawful, offensive, abusive, harmful or malicious.
The Company shall have the right to remove any such material that in its sole opinion violates, or is alleged to violate, the law or this agreement or which might be offensive, or that might violate the rights, harm, or threaten the safety of users or others. This Site uses a payment gateway (currently Stripe or Paypal, but subject to change at any time at our sole discretion and without notice) to process digital purchases you make on the Site. When you purchase a product or service from the Site, you certify that:
- you are an authorized user of the credit card you provide
- any credit information you provide is accurate and complete
- charges incurred by you will be honored by your credit card company and
- you will pay the charges incurred by you at the prices quoted on the Site at the time of purchase
Users may upgrade to a higher version of a Program at any time by paying the prorated difference between their purchase price and the current price of Program. No credit or refund will be issued for downgraded services.
Purchases and Online Commerce
If paying by debit card, or credit card, you give us permission to automatically charge your credit or debit card as payment for your Program, Product or Service without any additional authorization, for which you will receive an electronic receipt.
In the event that payment is not received by the date due, you will have a fourteen (14) day grace period to make the payment, otherwise the Program, Product or Services will be suspended and we reserve the right to cease your access immediately and permanently.
All information obtained during your purchase or transaction for our Programs, Products and Services and all of the information that you give as part of the transaction, such as your name, address, method of payment, credit card number, and billing information, may be collected by both us and our payment processing company.
You agree to only purchase goods or services for yourself or for another person for whom you are legally permitted to do so or for whom you have obtained the express consent to provide their name, address, method of payment, credit card number, and billing information.
You agree to be financially responsible for all purchases made by you or someone acting on your behalf. You agree to use our Programs, Products, Services, and Program Materials for legitimate, non-commercial purposes only and not for speculative, false, fraudulent, or illegal purposes.
If you make a purchase from one of our affiliates, or any other individual or company through a link provided on or through our Programs, Products or Services (“Merchant”), all information obtained during your purchase or transaction and all of the information that you give as part of the transaction, such as your credit card number and contact information, may be collected by the merchant and their payment processing company as well. Your participation, correspondence or business dealings with any affiliate, individual or company on or through our Programs, Products or Services, and all purchase terms, conditions, representations or warranties associated with payment, refunds, and/or delivery related to your purchase, are solely between you and the Merchant. You agree that we shall not be responsible or liable for any loss, damage, refunds, or other matters of any sort that incurred as the result of such dealings with a Merchant. Payment processing companies and Merchants may have privacy and data collection practices that are different from ours. We have no responsibility or liability for these independent policies of the payment processing companies and Merchants. In addition, when you make certain purchases through our Programs, Products or Services, you may be subject to the additional terms and conditions of a payment processing company, Merchant or us that specifically apply to your purchase. You release us, our affiliates, our payment processing company, and Merchants from any damages that you incur, and agree not to assert any claims against us or them, arising from your purchase through or use of our Website or its Content.
Refund Policy for Courses
You should only purchase a Course if you are prepared to do the work. With that in mind, we do offer a 14-day money-back guarantee on all our Courses, including Bot Essentials (ManyChat Edition and Chatfuel Edition).
If you take the Course and do a reasonable amount of work but feel that you’re not getting any value, please contact us within fourteen (14) days with the following information:
- Your full name and the email address you used when registering, buying or signing up (so we can find you in our system)
- A clear explanation for requesting the refund (so that we can improve the course)
We will review your request and issue a prompt and courteous refund.
- All returns and refunds are at the sole and absolute discretion of ThinkTuitive, LLC.
- If you downloaded the Training Material (videos, audios, PDFs, additional workbooks, and/or etc.), and then immediately asked for a return, we reserve the right to deny your request.
- Why? Because the purpose of the policy is to give people the chance to try the program risk-free, and if it does not work, they can get their money back. It was not designed to enable people to steal the Training Material.
- If you share your login details or course materials on a third-party site without our permission, we also reserve the right to revoke your access to the course WITHOUT ANY REFUND.
By using and/or purchasing any of our Programs, Products, Services or Program Materials, you understand and agree to this refund policy.

Refund Policy for Services
- There are no refunds on any services, workshops or coaching sessions. Also note:
- Partial refund will be not issued for any unused or leftover hours from a workshop or coaching session.
- Any unused minutes from a workshop or coaching session (minimum 15 minutes) can be “banked” to be used at a later date as a follow-up coaching session.
- Unused workshop(s) and coaching session(s) will expire twelve (12) months after purchase date. No refund will be issued for unused services.
Refund Policy for Templates
- There are no refunds on any templates.
Links to Other Sites and/or Materials
As part of the Service, the Company may provide you with convenient links to third party website(s) (“Third Party Sites”) as well as content or items belonging to or originating from third parties (the “Third Party Applications, Software or Content”). These links are provided as a courtesy to Site subscribers. The Company has no control over Third Party Sites and Third Party Applications, Software or Content or the promotions, materials, information, goods or services available on these Third Party Sites or Third Party Applications, Software or Content. Such Third Party Sites and Third Party Applications, Software or Content are not investigated, monitored or checked for accuracy, appropriateness, or completeness by the Company, and the Company is not responsible for any Third Party Sites accessed through the Site or any Third Party Applications, Software or Content posted on, available through or installed from the Site, including the content, accuracy, offensiveness, opinions, reliability, privacy practices or other policies of or contained in the Third Party Sites or the Third Party Applications, Software or Content.
Inclusion of, linking to or permitting the use or installation of any Third Party Site or any Third Party Applications, Software or Content does not imply approval or endorsement thereof by the Company. If you decide to leave the Site and access the Third Party Sites or to use or install any Third Party Applications, Software or Content, you do so at your own risk and you should be aware that our terms and policies no longer govern. You should review the applicable terms and policies, including privacy and data gathering practices, of any site to which you navigate from the Site or relating to any applications you use or install from the site.
Please be aware that ThinkTuitive may receive compensation for any purchase made through any Third Party sites or applications linked from our Service.
Copyright Complaints and Copyright Agent
(a) Termination of Repeat Infringer Accounts. The Company respects the intellectual property rights of others and requests that the users do the same. Pursuant to 17 U.S.C. 512(i) of the United States Copyright Act, the Company has adopted and implemented a policy that provides for the termination in appropriate circumstances of users of the Site who are repeat infringers. The Company may terminate access for participants or users who are found repeatedly to provide or post protected third party content without necessary rights and permissions.
(b) DMCA Take-Down Notices. If you are a copyright owner or an agent thereof and believe, in good faith, that any materials provided on the Site infringe upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act (see 17 U.S.C 512) (“DMCA”) by sending the following information in writing to the Company’s designated copyright agent at: Thinktuitive, LLC 310 S. - The date of your notification;
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
- A description of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
- A description of the material that is claimed to be infringing or to be the subject of infringing activity and information sufficient to enable us to locate such work;
- Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and/or email address;
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

By posting any User Content via the Site, you expressly grant, and you represent and warrant that you have a right to grant, to the Company a royalty-free, sublicensable, transferable, perpetual, irrevocable, non-exclusive, worldwide license to use, reproduce, modify, publish, list information regarding, edit, translate, distribute, publicly perform, publicly display, and make derivative works of all such User Content and your name, voice, and/or likeness as contained in your User Content, if applicable, in whole or in part, and in any form, media or technology, whether now known or hereafter developed, for use in connection with the Site.

The service, including but not limited to text, images, graphics or code, are the property of ThinkTuitive, LLC. and are protected by copyright, trademarks, database and other intellectual property rights. You are granted a single-use, non-exclusive, non-transferable, revocable license to access and use the Program content and resources.
You hereby agree that you will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found in the Programs, Products, Services and Program Materials.
You may display and copy, download or print portions of the material from the different areas of the service only for your own personal or business use. Any other use, without written permission from ThinkTuitive, LLC is strictly prohibited and may violate copyright, trademark and other laws. These terms do not grant you a license to use any trademark of ThinkTuitive LLC. or its affiliates. You further agree not to use, change or delete any proprietary notices from materials downloaded from the service.
All intellectual property, including Company’s copyrighted program and/or course materials, shall remain the sole property of the Thinktuitive, LLC. No license to sell or distribute Company’s materials is granted or implied.
By purchasing any part of the Service, you agree (1) not to infringe any copyright, patent, trademark, trade secret, or other intellectual property rights, (2) that any Confidential Information shared by the Company is confidential and proprietary, and belongs solely and exclusively to the Company, (3) You agree not to disclose such information to any other person or use it in any manner other than in discussion with the Company.
Further, by purchasing any product or service, you agree that if you violate, or display any likelihood of violating, any of the agreements contained in this paragraph, the Company will be entitled to injunctive relief to prohibit any such violations and to protect against the harm of such violations.
You are permitted to use our Programs, Products, Services and Program Materials as follows:
You may download and/or print Program Materials for your own personal use in your business.
However, you are not permitted to share, sell, reprint or republish any other of our Program Materials, including handouts, for resale or mass reproduction purposes for your own business use.
All rights not expressly granted in these terms or any express written license, are reserved by us.
You Are Prohibited from Sharing Information with Others. As a Licensee, you understand and acknowledge that our Programs, Products and Services and the Program Materials have been created, developed or obtained by us through the investment of significant time, effort and expense, and that this information is a valuable, special and unique asset of ours which needs to be protected from improper and/or unauthorized use.
When you enroll in or purchase our Programs, Products or Services, you agree that you are clearly and expressly PROHIBITED from doing the following:

You agree and understand that prohibited use, improper and/or unauthorized use may give rise to a civil claim for damages and/or be a criminal offense.
Limitations on Linking and Framing. Media Release. By participating in our Programs, Products and Services, and using our Program Materials, including our Facebook community, you consent to photographs, videos, and/or audio recordings that may be made that may contain you, your voice and/or your likeness. In our sole discretion, we reserve the right to use these photographs, videos, and or/audio recordings and/or any other materials submitted by you to us in connection with your participation in our Program, Product or Services in our current or future Programs, Products or Services, and/or our marketing or promotional efforts, without compensation to you at any time, now or at any time in the future.
Request for Permission to Use Content

Independent Contractor Status

Each party shall be an independent contractor in its performance hereunder and shall retain control over its personnel and the manner in which such personnel perform hereunder. In no event shall such persons be deemed employees of the other party by virtue of participation or performance hereunder.
User Consent to Receive Communications in Electronic Form
For contractual purposes, you (a) consent to receive communications from the Company in an electronic form via the email address you have submitted; and (b) agree that all Terms, agreements, notices, disclosures, and other communications that the Company provides to you electronically satisfy any legal requirement that such communications would satisfy if it were in writing. The foregoing does not affect your non-waivable rights.

Opting out may prevent you from receiving messages regarding the Company or special offers.
